Sample Section 504 Plans for Managing Food Allergies

A 504 Plan is a type of plan written by the school in collaboration with a student and his family. While the purpose of a 504 Plan is essentially the same as that of an Interdisciplinary Health Plan (IHP), a 504 Plan differs from an IHP in that it provides guidelines for changes in the classroom and in other locations or activities that achieve the goal of providing a safe education.

Section 504 Plans can vary from student to student and from school to school.  The following sample 504 Plans were obtained by KFA from the Department of Education's Office of Civil Rights to provide some insight if you have to work with your child's school to develop a 504 Plan to manage food allergies in the school setting. These are examples to illustrate how the content and format of a 504 plan varies from student to student and from one school to the next, depending upon what the individual student needs and whether the school has existing food allergy policies in place.

Sample 504 Plans


Preview Sample A:

Procedures and/or Protocols Governing Peanut Tree Nut Allergy Risk Management in the Classroom:

A letter written by the principal will be sent home to the student's teammates alerting parents or guardians of the severe Peanut - Tree Nut Allergy suffered by student(s) on their child's team. The letter will include:

-The request that all students and parents voluntarily refrain from sending/bringing any peanut and/or tree nut products or by-products into [school name] or to any school-related activities.

-A statement of how bullying, harassment, or threatening of a student with a Peanut -Tree Nut Allergy will be disciplined according to the county policy for bullying,
threatening, or harassment.

Preview Sample B:

-Ensure that at least one Peanut - Tree Nut Allergy trained individual who can properly administer epinephrine is at the School during all regular school hours and at all School-sponsored activities in which the Student participates.

-Ensure that the Student's parents are immediately informed of any Peanut or Tree Nut Allergy related reaction by the Student.

- Upon approval by the Student's parents and physician, and the School Nurse, permit the Student to carry her own medication, including an epinephrine auto-injector, unless prohibited by applicable regulations or by abuse of this right by the Student.

-The Student's classroom and the Peanut Tree Nut free table in the cafeteria will not be used when the facility is reserved for activities.

Preview Sample C:

1. Is the student disabled as defined by Section 504 of the Rehabilitation Act of 1973?

2. Describe the nature of the disabling condition: Doctor's diagnosis of peanut and/or tree nut allergies.

Symptoms; tingling lips and mouth, flushing face or body, itching eyes, nose, face, diarrhea, wheezing, swelling, vomiting, hives, feeling of unease.

3. Does the disability substantially limit a major life activity? Yes
In which area? Breathing

4. Ensure that this Plan the Student's Food Allergy Emergency Plan (the Plans) are fully implemented and,when necessary, appropriately modified.

Preview Sample D:

Peanut/tree nut products will be banned from the classroom. This requirement is

o Lunches packed from home.

o Lunches brought into the cafeteria from area restaurant.

o Snacks and/or refreshments from home or provided by any school personnel.

The cafeteria personnel will not serve any food items containing peanuts, tree nuts or by-products of either.

All Students will wash their hands with soap and water immediately upon leaving the cafeteria after lunch.
